Partner & Family Visas

If you have a partner who is an Australian Permanent Resident or Citizen or an eligible New Zealand Citizen you may be eligible for a Partner visa.

 

There are onshore and offshore options. 

  • Subclass 820/801: Allows partners who are in Australia to remain in Australia while the application is processed

  • Subclass 309/100: These visas are for partners outside of Australia at the time of applicationSub

 

There are two stages of processing in most cases. Generally, the first stage is the grant of a temporary visa and and two years after the initial application is granted the applicant may qualify for a permanent visa.
 

In some cases, both visas could be granted together. This depends on individual circumstances. 
Partner visas require you to meet the legislative definition of spouse or defacto relationship and evidence that accordingly.
